Two Resolutions Slated
For Vote at February Luncheon

As mentioned at the January luncheon, you will be asked to vote at the February luncheon on two resolutions.

The first is Tom Stubbs’ resolution, tabled at the November luncheon, to express appreciation for Senior Judge Hilton Fuller’s leadership and courage. A copy of this resolution was distributed at the January luncheon, albeit with a typo inserted by DBA President Katie Wood in editing paragraph four. That typo has been corrected in the version posted on this website.

The second resolution is Katie’s proposal to emulate the Atlanta Bar Association by creating a policy for dealing with unjust criticism of judges. The Atlanta Bar’s policy was printed in last month’s newsletter and a version edited to conform to the DBA is posted here.

Please review these proposals, particularly in light of current events.

Is There a Tax Refund Waiting for You?

Our DBA Treasurer Jack Fishman says there may be refunds waiting for those of us who paid the City of Atlanta’s occupational tax for the practice of law between Feb. 16, 1996, and Dec. 31, 2004.

Although the frequently asked questions page of the Atlanta Law Department’s website suggests that attorneys entitled to a refund will receive one without taking action, Jack’s experience has been otherwise. He writes: “Since my practice had been located in the City of Atlanta for over three years, I was waiting for my refund of the Lawyer Tax that Atlanta had imposed on us. . . . Not being bashful and wanting my money, I called the City of Atlanta Legal Department. It seems that instead of the city determining who paid and refunding those amounts, you must file a claim to get the refund. The city has imposed a deadline of July 1, 2008, to file this claim.”
